Licence and scope
These Terms of Use are the end-user licence agreement between you and Idion for the Nixo app. By downloading or using Nixo, you accept them.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nixo for your own use. If you obtained Nixo from the Apple App Store, this licence is limited to use on Apple- branded devices that you own or control, and is subject to the Usage Rules in the Apple Media Services Terms and Conditions, including any permitted family sharing. If you obtained Nixo from Google Play, the equivalent Google Play terms apply.
You may not sell, rent, sublicense, or redistribute Nixo, or copy, modify, decompile, or reverse engineer it except to the extent that applicable law expressly permits. Our Acceptable Use Policy describes further behaviour that is not allowed.
Eligibility
You must be old enough to enter into a binding agreement where you live in order to use Nixo. If you are using it on behalf of someone else, you confirm you are authorised to accept these terms for them.
Accounts
You can use Nixo without an account, and nothing in the app is reachable only by an account holder. If you create one, it is an email address and nothing else, and you are responsible for keeping access to that address secure and for what happens under the account. Tell us promptly if you believe someone else has gained access.
We may suspend or close an account that is being used in breach of these terms or our Acceptable Use Policy. You can delete your own account at any time from Settings inside the app, as described on our Account Deletion page. Deleting your account does not cancel a subscription, which is managed by the store you bought it from.
Acceptable use
You agree to use Nixo lawfully and as intended. Our Acceptable Use Policy sets out what is not allowed, and it forms part of these terms.
Feedback
If you send us suggestions about Nixo, including a disagreement with one of our published rules, we may use them without obligation to you. This does not affect your rights in anything else you create.
Verdicts, rules and AI
Nixo tells you that a named ingredient appears in a packaged food and that this breaks one of a small set of rules we publish in full inside the app. It is not a health, medical, nutritional or dietary claim, it is not professional advice of any kind, and it does not say that a food is healthy, unhealthy, safe, toxic or harmful.
Two parts of the answer can be wrong. The barcode path reads an ingredient list from an open public database that we do not control and cannot guarantee is current, and a product can be reformulated after we read it. The panel path uses AI to turn a photograph of a printed ingredient list into text, and that reading can be incomplete or mistaken. Our rules are also a closed list, so an ingredient we do not carry passes without comment. Decisions about what you eat remain yours, and the packet in your hand is the authority. See our AI Policy.
Subscriptions
Nixo offers an optional paid subscription. The first ten scans are free and belong to the install, and the subscription buys the eleventh. Nothing you have already scanned is ever taken away: your history, your verdicts, the rulebook and the weekly count stay fully open whether you subscribe, never subscribe, or stop. Prices, billing periods, and any free trial are shown in the app before you buy, and payment is taken by the Apple App Store or Google Play under their terms.
At the time of writing the plans are 49.99 US dollars a year, with the first seven days free, or 8.99 US dollars a month, with no trial. The price in your own currency and any local tax are shown by the store before you confirm.
Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel at any time in your device's subscription settings, reachable in one tap from Manage subscription in the app, and cancelling stops the next renewal rather than ending the period you have already paid for. If a free trial is offered, any unused part of it ends when you buy a subscription. Refunds are handled by the store you bought from, under its own policy, except where the law where you live gives you a further right of withdrawal.
The retention offer
If you start to cancel, we may show you a single discounted offer once. It is 24.99 US dollars a year, it is shown at most once per subscriber ever, and it is shown only to monthly subscribers: an annual subscriber, including one inside a trial, never sees it. You can decline it and continue to the store's own cancellation page in one tap, with nothing in between. We do not show it more than once, we do not show it to people who are already on the discounted plan, and we do not interrupt or intercept the store's own cancellation flow.
Before either the offer or the way out, one skippable screen asks why you are leaving. It has four options and a skip that takes one tap, and it is the only place in Nixo where you can tell us that you think a verdict or a rule was wrong.
Intellectual property
Nixo, including its software, design, and the rulebook we publish inside it, belongs to Idion and its licensors, and is protected by intellectual property law. These terms grant you a licence to use it, not any ownership of it.
Barcode lookups are answered from Open Food Facts, a public food database made available under the Open Database Licence (ODbL) version 1.0. That database and its contents remain the work of its contributors and are used here under that licence, which permits use and adaptation with attribution and on share-alike terms for a derived database. Nixo credits Open Food Facts and names its licence on the rulebook screen inside the app, and the credit is always visible there rather than filed away in a settings menu. The rules Nixo applies, and every verdict it produces, are our own work and are not part of that database.
If a third party claims that Nixo infringes their intellectual property rights, we, not Apple or Google, are solely responsible for investigating, defending, settling, and discharging that claim.
Availability
We aim to keep Nixo available, but we do not guarantee it will be uninterrupted or error-free. Access may be limited by maintenance, by problems outside our control, or by your own device or connection. A new scan needs a connection; your history, your held verdicts and the rulebook do not, and they stay readable offline.
Changes to the service
We may change, add, or remove features as Nixo develops, and the published rulebook may change with a future version of the app. A verdict already in your history is never rescored: it stays as it was on the day, and each card names the rules that were applied to it. Where a change materially reduces what a paid subscription provides, we will make a reasonable effort to tell you in advance.
Third-party links
Nixo may take you to services we do not operate, such as your device's own subscription management screen or your system settings. We are not responsible for their content or their practices, and their own terms and privacy policies apply when you use them. Nixo carries no advertising, no affiliate links and no route to a shop, and the alternative product named on a card is never a link to buy anything.
Third-party terms and export
You confirm that you are not located in a country subject to a United States government embargo, or designated by the United States government as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.
You must comply with any applicable third-party terms of agreement when using Nixo. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms of Use and, upon your acceptance, will have the right to enforce them against you.
Termination
You may stop using Nixo at any time and delete your account. We may suspend or end your access if you breach these terms, if we are required to by law, or if we discontinue the app. Terms that by their nature should survive termination do so.
Disclaimers
Nixo is provided on an as is and as available basis. To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non- infringement. Nothing here limits rights you have under consumer law that cannot be limited.
Limitation of liability
To the extent permitted by law, Idion is not liable for indirect, incidental, special, or consequential losses, or for loss of data or profits, arising from your use of Nixo. Our total liability for any claim relating to Nixo is limited to the amount you paid us for it in the twelve months before the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Resolving a problem
If something goes wrong, contact us first at [email protected]. Most problems are resolved that way and it is faster for both of us.
If we cannot resolve it informally, the courts identified below have jurisdiction. If you are a consumer in the European Union, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may also use the European Commission's online dispute resolution platform.
Governing law
Nixo is operated by Idion, based in Spain. These terms are governed by the laws of Spain, and the courts of Spain have jurisdiction, without prejudice to any mandatory consumer protection you have where you live.
Export compliance
You may not use or export Nixo except as permitted by the laws of Spain, the European Union, and the United States, and by the laws of the place where it was obtained.
App Store and Google Play terms
If you downloaded Nixo from the Apple App Store or Google Play, the following also applies. These terms are an agreement between you and Idion only, not with Apple or Google, and Apple and Google are not responsible for Nixo or its content.
Apple and Google have no obligation to provide maintenance or support for Nixo. In the event Nixo fails to conform to any warranty, you may notify Apple or Google, and they may refund the purchase price, if any, but that is their only warranty obligation, and any other claims, losses, or damages are our sole responsibility, not theirs.
Apple and Google are not responsible for addressing any claims relating to Nixo, including product liability claims, claims that Nixo fails to meet applicable legal or regulatory requirements, or claims under consumer protection law. Apple and Google are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
Maintenance and support for Nixo is our sole responsibility. Apple and Google have no obligation to provide it, and questions should be sent to the support address below.
